Copyright and DMCA Policy

Effective date: October 28, 2026 · Last updated: October 28, 2026

1. Our policy

Holnix, Inc. (“Holnix”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, Holnix will respond to valid notices of alleged copyright infringement regarding content made available through the Holnix platform (the “Service”), including catalogs that Subscribers publish so that third parties can view them. Uploading or publishing content that infringes another party’s rights violates our Terms of Service.

2. Designated Copyright Agent

Holnix has designated the following agent to receive notifications of claimed infringement:

Jorge Arévalo
Holnix, Inc.
150 SE 2nd Ave, Ste 300, Miami, FL 33131, United States
Phone: +1 (305) 686-7796
Email: dmca@holnix.com

Holnix’s designation is on file with the U.S. Copyright Office DMCA Designated Agent Directory (https://www.copyright.gov/dmca-directory/) under registration number DMCA-1077450.

3. Notice of infringement

To report content you believe infringes your copyright, send a written notice to our Designated Agent that includes:

  1. a physical or electronic signature of the copyright owner or of a person authorized to act on their behalf;
  2. identification of the copyrighted work claimed to have been infringed;
  3. identification of the material claimed to be infringing and information reasonably sufficient to locate it within the Service;
  4. your contact information (name, address, telephone number and email);
  5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  6. a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

4. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that it was removed or disabled by mistake, may be liable for damages. Please do not make false claims.

5. Removal

Upon receipt of a valid notice, Holnix will act expeditiously to remove or disable access to the material in question and will make reasonable efforts to notify the user who provided it.

6. Counter-notification

If you believe your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Agent that includes:

  1. your physical or electronic signature;
  2. identification of the material and of its location before it was removed or disabled;
  3. a statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; and
  4. your name, address and telephone number, a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Holnix may be found), and a statement that you will accept service of process from the party who filed the original notice or its agent.

If Holnix receives a valid counter-notification, it may restore the removed material in 10 to 14 business days unless the original complainant first notifies our Designated Agent that it has filed an action seeking a court order to restrain the allegedly infringing activity.

7. Repeat infringers

In accordance with 17 U.S.C. § 512(i), Holnix will, in appropriate circumstances and at its discretion, terminate the accounts of users who are repeat infringers. A “repeat infringer” is a user who has been the subject of two or more valid infringement notices that Holnix has acted upon within any twelve (12) month period.

8. Discretionary removal

Holnix may remove or disable access to any content that it reasonably believes may infringe the rights of a third party, whether or not a formal notice has been received, consistent with its Terms of Service.

9. Contact

Notices and counter-notifications must be sent to the Designated Agent at dmca@holnix.com, or by mail to the address in Section 2.
